The rental and use of the bicycle imply the User’s knowledge and unconditional acceptance of the general rental conditions, pricing, opening and closing hours of Out Bike di Battistella Alberto, owner of the equipment, headquartered in Jesolo (VE), Via Olanda n. 90 – VAT No. 05305050261.

The use of the bicycle requires physical fitness and technical ability. By renting the bicycle, the User declares to possess adequate skills and competence, without any reservation.

To rent a bicycle and related accessories/components, the User must present a valid ID and complete the contract.

The bicycle must be used exclusively as a means of transport and handled with care, common sense, and diligence to avoid damage to the bicycle and its accessories/components. It is forbidden to use the bicycle for commercial activities or to lend it to others.

The User is responsible for the bicycle and its accessories/components until they are returned to the Manager. The User is also responsible for any damage caused to themselves, the bicycle, third parties, or property during use. No compensation can be claimed from the Manager.

The User must comply with traffic laws. The Manager declines any responsibility for improper use of the bicycle or failure to comply with traffic regulations.

The purchase of guided excursions and tours implies that both adult participants and accompanied children accept the risks arising from objective hazards present in the area where the excursion takes place and confirms they possess adequate technical and physical abilities.

During organized excursions and tours, the User agrees to follow the guide’s instructions, ensure proper and careful handling of rented equipment, avoid endangering themselves or others, and comply with traffic laws.

The Manager may carry out checks on Users during bicycle use and may request its return if improper use is detected. The Manager may refuse rental to individuals under the influence of alcohol or drugs (in accordance with Articles 186–187 of the Highway Code) or for other reasons at their sole discretion.

In case of loss of keys or accessories, or damage, the Manager will charge the User the amount necessary to restore the bicycle to its original condition. In case of total theft, the User must compensate the Manager for the full replacement value.

The bicycle must be returned within the agreed time and to the same location where it was rented. The bicycle is considered returned only when handed directly to the Manager; parking it outside the rental point during closing hours does not constitute return. Failure to return the bicycle without prior notice or justified exceptional reasons will be considered misappropriation and reported to judicial authorities.

The User may request the Manager to collect the bicycle; the cost is €0.80 per kilometer, calculated from and to the Out Bike headquarters. The Manager is not obligated to provide this service, and failure to do so cannot be considered a breach. The Manager intends to retrieve the bicycle, but temporary circumstances may prevent intervention.

The User must pay for the rental from the start time until the actual return of the bicycle, including any additional charges for damages or theft (partial or total).

In case of theft, the User must provide the Manager with a copy of the report filed with the competent authorities and pay the replacement value, which will be refunded if the bicycle is recovered.

Pursuant to Article 13 of EU Regulation No. 2016/679 (“GDPR”), the Manager will process the User’s personal data in compliance with applicable laws and as described in the Privacy Policy. I consent to the processing of my personal data for the purposes and methods indicated in the Privacy Policy, expressly authorizing its use also for direct marketing purposes.
For matters not covered in this contract, the relationship between the parties is governed by the Italian Civil Code. Any disputes shall fall under the jurisdiction of the Court of Venice.
I also consent to receive WhatsApp communications regarding guided bike tour programs and commercial communications as provided in Article 14 of this contract.
