CODE OF CONDUCT FOR THE PROTECTION OF MINORS AND FOR THE PREVENTION OF HARASSMENT, GENDER-BASED VIOLENCE, AND ANY OTHER FORM OF DISCRIMINATION

Art. 1 – General Principles

AL2 Sport SSDaRL recognizes and guarantees the right of all Registered Members to be treated with respect and dignity. Every Member is required to maintain a respectful, fair sporting environment free from any form of abuse, violence, and discrimination. The primary right of Members is to be treated with respect and dignity and to be protected from all forms of abuse, harassment, gender-based violence, and any other type of discrimination as provided for by Legislative Decree no. 198/2006, regardless of ethnic origin, personal beliefs, disability, age, gender identity, sexual orientation, language, political opinion, religion, economic status, birth, physical, intellectual, relational, or sporting condition.

AL2 Sport SSDaRL recognizes and guarantees the full protection of the right to physical and psychological health and well-being of its Members, especially minors, as a predominant and overriding value, even over sporting results.

This Code of Conduct is an integral part of the Organizational, Management and Control Model of Sports Activities and implements its objectives.

Art. 2 – Scope of Application

This code applies to:

  • all Registered Members of AL2 Sport SSDaRL;

  • all workers, collaborators, volunteers, and in general all sports operators of AL2 Sport SSDaRL who, in any capacity or role, are in contact with Athletes or involved in sports activities;

  • all those who, in any capacity, have dealings with AL2 Sport SSDaRL and are in contact with Athletes.

Art. 3 – Types of Abuse, Violence and Discrimination

To safeguard and protect Members, the following constitute relevant conduct for the safeguarding policy:

a) “Psychological abuse”: any unwanted act, including disrespect, confinement, oppression, isolation, or any treatment that may affect the sense of identity, dignity, and self-esteem, or intimidate, disturb, or alter the mental state of the Member, even if carried out through digital tools.

b) “Physical abuse”: any act, whether actual or attempted (including hitting, punching, beating, choking, slapping, kicking, or throwing objects), that is capable, either actually or potentially, of causing direct or indirect harm to health, trauma, physical injuries, or impairs the psycho-physical development of a minor, thus compromising their healthy and serene growth. This also includes forcing Members to perform inappropriate physical activities (e.g. administering training loads inappropriate to age, gender, structure, and physical ability), forcing sick or injured Athletes to train, and the improper, excessive, illegal, or arbitrary use of sports equipment. Also included are behaviors that promote the use of alcohol, prohibited substances, or doping practices.

c) “Sexual harassment”: any unwelcome and unwanted act or behavior of a sexual nature, whether verbal, non-verbal, or physical, that causes significant discomfort or disturbance. This can include inappropriate body language, sexually explicit remarks or insinuations, unwelcome sexual advances or messages (including emails, texts, letters, or any other sexual communication), especially if intimidating, degrading, or humiliating.

d) “Sexual abuse”: any behavior or conduct of a sexual nature, with or without physical contact, that is unwanted or where consent is coerced, manipulated, not given, or denied. This includes forcing a Member to engage in inappropriate or unwanted sexual acts or observing them in inappropriate contexts.

e) “Negligence”: the failure of a manager, coach, or any Member to act—due to the duties of their role—after becoming aware of one of the incidents, behaviors, or acts described in this document, resulting in harm or creating a risk of harm. It may also include persistent and systematic neglect of the physical and/or psychological needs of a Member.

f) “Neglect”: failure to meet basic physical, medical, educational, or emotional needs.

g) “Religious-based abuse”: preventing, limiting, or conditioning the right to freely practice one’s religion and worship publicly or privately, provided that the rites are not contrary to public decency.

h) “Bullying and cyberbullying”: any offensive and/or aggressive behavior by an individual or group, either in person or through social media or other communication tools, whether isolated or repeated over time, against one or more Members, with the intent to assert power or dominance. This includes repeated humiliation, criticisms of physical appearance, verbal threats, gossip, or intimidation related to sporting performance or threats to damage property.

i) “Discriminatory behavior”: any behavior aimed at causing discriminatory effects based on ethnicity, color, physical traits, gender, socio-economic status, sporting performance and ability, religion, personal beliefs, disability, age, or sexual orientation.
